Initial thoughts:

No surprises in terms of evidence, or defense attorney’s plea, or the length of trial.   Also no surprises with what the prosecutor is asking.  This is the first one of the many drug cases to come in this overall investigation.  Tactically, the prosecutor will want to ask for a stiff punishment to set the tone.  You start high knowing that the judge may knock it down.  Then the sentence may serve as sort of a baseline for the many other cases to come.  That would be my guess.  Also, didn’t read about the prosecutor’s stated rationale for the recommended punishment.  It would give a sense how strongly the prosecutor is actually pushing for/really feel about the recommended sentence.  If you read it somewhere, pass it on.

在檢察官對刑罰的要求這方面,也沒有什麼驚喜.這是第一宗在許多的毒品案件裡,被全面調查的案件。

這是我的猜測。此外，我也沒有閱讀有關檢察官所指出他建議處罰的理由說明。

它將給我們一個明確的訊息,代表檢察官實際上在推動案件上的實力/真正感受到為何他會做出這樣的建議刑期。如果您在任何的地方閱讀到相關資料，請將資料傳給我。

Were his parents/grandparents there?
他的父母和祖父母在那裡？
 

JH looked worn but solemn and together.  He spoke calmly and his answers were very consistent with his confession at the police station.  No excuses. No drama.  No embellishment.  Straightforward and sincere.  The way he always speaks.  All good. 

JH看起來筋疲力盡,但很莊嚴,也和我們一起共同努力著。

他很冷靜的回答,而且他的答案都很符合他在警察局裡所做下的供詞。

沒有任何藉口。沒有戲劇性的說法。無潤飾性的語言。是直截了當和真誠的。

就像他一慣的說話方式.全部都表現得很好的。

Let’s see how the judge will rule. Hopefully a suspended sentence, or at least a partial suspension.  Do you get a sense what the general public’s (not fan’s) reaction in Korea is – as reported by newspapers and TV?  The judge is human too and could be influenced by public sentiment. 

就讓我們來看看法官會如何裁定。希望是緩刑，或至少是把部分刑罰暫緩一些。

你可有發現一般公眾的（而不是粉絲的）在韓國的反應是如何的-是否有如報紙和電視所報導的一樣？

接著這位律師也有說,智勳的律師可以看出來很有策略.

智勳在回答法庭上的提問,或者智勳的律師在為他辯護時,並沒有把智勳是第一時間自己坦白承認的事實拿出來做有利的證詞.

很有可能是把這點保留在跟檢察官協商,或和法官要求減輕刑罰時才用上.

而且目前也只說智勳是家庭的經濟來源,需要供養父母親,並沒有把爺爺奶奶也一併提出.

這也是加強之後智勳的律師在日後幫他辯護時很有利的策劃之一.

PS:所以請大家如果在哪裡有看到關於檢察官提出控訴的理由,或檢察官以什麼原因把刑罰設置於罰款和1年徒刑,在可以被轉載的情況下,請馬上貼來我家.

第二封email:

just saw the y-star TV report posted by Moonlight drop.  I've been wondering when the JH team would start to be on the offense and try to shape public opinion and set record straight.  This may be the start.  The JH close friend heard on the y-star show seemed to be reading from a script (a very good one, I might add, based on the very imperfect translation I got fr the translation tool), and the questions sounded pre-arranged.  Good move!    News reports are dominated by "group think."  Let's hope what the close friend said would pick up some momentum in the news cycle and get  traction.  Let's see if other friends may come out and say something along the same line.  It would have been very risky and tricky for the attorney or JH to criticize the police conduct in selectively revealing his name and feeding him to hungry media in an open court. That would have made him appear bitter and unremorseful.  After all, he did the crime.  However, it's much easier for others to talk about the unfair police conduct and what it did to his basic right and dignity.   A sharp contrast with JH's simplicity and honesty .....

畢竟，他確實有犯罪。

然而，因為這些不公平的行動,將更容易讓其他人談論關於警察不公平的行為,以及沒有對他保留基本權利和尊嚴。這些行為將對JH的簡朴和誠實,形成鮮明的對比.....

Sympathetic reporting would help make his life a bit more bearable.  And will help w/ the sentencing. 
有同情心的報導將有助於他對人生有多一點的忍耐力。並有助於贏得/判刑。

The defense attorney talked about the 2009/10 enlistment date.  Wonder if  the judge may impose a 3-month  jail term with or w/o a partial suspension .... Of course, full suspension and expungement of criminal record at the end of suspension would be ideal.
該辯護律師談到2009-10月的入伍日期。不知法官可能會處以3個月的監禁或/暫停部分刑罰....

當然，在案件結束後,完全停止並抹去犯罪記錄是最理想的。

10-6/09-補充--這就是這位律師所提到,智勳的朋友在接受y-star訪問時,說出的對他有利,很可能影響群眾和法務人員在審訊時,對他有好印象的說詞:

阿呆說~ 他是無意中吃的，知道自己吸食後從那天起就和那２人斷絕往來，

後來就處在恐懼與自責的狀態。4/26事件爆發後就不出門,

朋友說他看起來很苦悶，從沒看過他那種樣子．．．

還有問到既然是一年多前發生的事，檢察官也沒拿到不證據，為什麼要承認?

朋友說，他們其實強力建議朱不要承認，但是他說除了害怕毒品外，說謊是欺騙自己也欺騙他的粉絲們,坦白後覺得很快樂
