這段日子,我一直都有和這為匿名的美國律師交流心得.很多時候在和她交談後,也許因為她專業的分析,冷靜的判斷,有力的說詞,都可以好好安撫我的心情.感覺她雖然也在擔心,卻一直都對判決保有很強烈的信心.
感謝她常常像個守護者一樣扶我一把.而且不論她多忙,除非她跨洲公幹,否則幾乎是我一封email過去,幾小時後她就馬上會回答一篇長長的email給我安慰.月小亮其實也有脆弱,忐忑不安的時候.而且可以找到來傾訴的人,3根手指就可以數出來.這位美國律師,就是其中一位我的心靈補貼強力劑.真的很謝謝她.
昨夜把消息告訴她後,她馬上回答了.我覺得看了之後,心情穩定得比較多.
同理.我不公開是不想被有心人說我造謠生事.看過的朋友們也請不要在任何地方公開或討論文章內容.不然她真的會採取法律行動追究,誰是洩密者.所以謝謝大家的合作,別把這規則給毀了

I’m not surprised. The law has a speedy trial requirement (“speedy” does not refer to the trial length itself, but the time between filing of the indictment by the prosecutor and the date the trial is set by the court). His was one of the first to be filed. Also, the outline of the case seems simple enough. Its quick move through the process and to trial would seem to confirm that. The newspaper/TV accounts have been highly inflammatory. However, if you put aside all the inflammatory headlines and pictures (the mass media clearly find him as irresistible as his fans -- sigh!!), the news accounts are quite consistent about the underlying “story”: (a) very quick confession to use of E and/or K; (b) use was limited to two occasions over a year ago; (c) use took place while drunk; (d) use took place in a private place (was not flaunted in a public place, such as one of the clubs that have been reviled by media and the public lately); (e) user felt remorseful afterwards and stopped immediately.
我一點都不覺得奇怪。該法律已達至迅速審判的要求（ “迅速”並非指審判時間長度本身，而是指檢察官提交的起訴書時間和由法院制定的審判日期）。
他是第一個被提訴的。此外，議程的情況似乎很簡單。其迅速的處理和審判過程似乎也得到了證實。
報章/電視台已極具煽動性的關注此事件。但是，如果拋開所有煽動性的頭條新聞和圖片（大眾媒體應該已經明確地得知,他其實是壓倒性的獲得粉絲的支持-一感嘆！ ） ，
新聞媒體是相當一貫的關注於案件中一些基本“故事” ：
（一）非常快速度地招供自己的確使用E和/或K ;
（ b ）使用僅限於兩次---在一年多前;
（ c ）使用時發生醉酒;
（ d ）發生在私人場所（不在公共場所炫耀，如近來,有一個俱樂部,已經遭受到媒體和公眾的唾罵） ;
（e ）使用者感到懊悔,事後也立即停止。
If the confession was voluntary and the prosecutor has good corroborating evidence (statements by other participants in the private party and hair sample result), then the case should move quickly. The question becomes how persuasive the defense team is with arguing the exculpatory circumstances or mitigating factors, and whether the justice system is eager to use him as an example because of his celebrity status (would they be weary of the human rights complaints about singling out entertainers for “special” treatment?). Of the 80 plus people that the police said were caught in the investigation, about 70 appeared to be users only. Somehow I don’t see the judicial system throwing all these users in jail. I’m also guessing that, among the 70, his use record would not rank as one of the more serious ones. Let’s hope the judicial system focuses on administering just and fair prosecution, not persecution. There’s been plenty of persecution going around already. (Of course, if the prosecutor’s case has holes, a good defense attorney could certainly pick it apart!) In any case, good to hear he has retained good legal counsel!

I could be wrong, but I don’t see a long trial based on what I read. The shorter the trial, the less room there is for sensational news.

I think it’s good to have a speedy and formal resolution, even if the process of getting there and the aftermath will be painful. Finality can bring clarity. And clarity can bring forward movement and hope. As long as his case is in limbo, every news account will continue to use him as the “poster boy” for the ever-widening drug scandal and other “moral corruption” problems of the young and the chic. As long as his case is in limbo, he is really not in a position personally to say anything or do anything without generating more media hysteria, eliciting more questions, or being misinterpreted. As long as his case in is in limbo, it’s awkward and probably career-damaging for his friends or colleagues to come out and show support. The earlier his case is finalized, the earlier there would be an “official story” of what he did or did not do and what the punishment was. It would be ugly for a while and there would be plenty of pundits offering all sorts of opinions. But then the media will have to move on because his case will start to lose its newsworthiness and other celebrities will take his place. The earlier his case is finalized, the earlier he can move on, and be allowed to move on. He could choose to talk about this chapter of his life, he could choose to reach out to his fans, and he could choose to remain away from public’s prying eye. The important thing is he could start to plan the next phase of his life. And other professionals who may be interested in working or associating with him in the short run or in the long run could also begin to make plans too.
我認為有快速和正式的決議是很好的，即使在過程中和如何善後將是痛苦的。
終局可以帶來更為明晰的結果。而明晰度可以帶來前進的動態和希望。
---只要他的案件一直在進行狀態中，每個新聞媒體將繼續使用他的“海報男孩”的身份,為日益擴大的毒品醜聞和其他“道德敗壞”問題,讓他成為年輕人和時尚的典範。
---只要他的案件是在進行當中，他確實是不能夠以個人的角度,親自說什麼或做任何事情，這樣才不會產生更多的媒體歇斯底里症狀，引起更多的問題，或者被誤解了。
---只要他的案件是在進行中，將會讓他覺得尷尬,也可能面臨事業上的危機,這樣或許會讓他的朋友和同事,站出來和表現他們對他的支持。
他的案件越早拍案確定，越早會有一個“官方故事”,說他做過什麼，或沒有做什麼和將有怎麼樣的懲罰。
這局面一開始時.將會有一陣子的難以面對，之後將有大量的學者提供各種意見。
但隨後媒體將繼續前進，因為他的案件將慢慢開始失去其新聞點,其他名人會接替他曝光率極高的位置。
他的案件越早被定奪，他就可以越早向前邁進，而且還可以繼續前進。
他可以選擇談論他生活裡的這一章，他可以選擇向他的粉絲們伸出雙手，他可以選擇對公眾刺探的眼神保持距離。
重要的是他可以開始計劃他生命裡的下一階段。在短期內或從長遠來看,其他專業人員或許可能對與他一起工作感到興趣或認同於他，這樣他也可以開始制定未來的人生計劃了。
I’m also glad that his drug thing came to light in April rather than later. Imagine the humiliation or the even greater financial implications he would have faced if he were in the middle of the fan meeting or filming Tokyo Tower or playing baseball on TV. Or if he had to go about doing his work and pretending nothing was wrong, like other celebrities, while at the same time under fear of imminent indictment? He took a very clean and straight path. Time may well show the wisdom of that path.

I can’t explain it but I’m somehow strangely optimistic right now.

But shame on the police for the way it gleefully picked and chose which suspect’s identity to publicize and which suspect’s identify to shield. (This may make me unpopular but my criticism goes to the release of the sensational footage of the accused traffickers as well. No matter who the suspect is and what the suspected crime is, it’s always important to uphold the Integrity and fairness of the criminal process. Otherwise, it’s too easy for people in the position of authority or power to act arbitrarily or commit abuse.) Shame on the police also for the way it broadcast its investigation early in the game, at the expense of preserving evidence or the integrity of the investigation itself. Just imagine all the illicit drugs being flushed down the toilets when the news broke out in April!

Similar cases involving other celebrities were submitted to the prosecution two weeks ago. Will the semi-government-owned TV stations come out with a ban soon? Do the TV stations become moralistic only if the names have been revealed to the public by the police (surely the TV stations and the management companies are not in the dark about the names)? Do they decide to follow the “innocent till proven guilty” principle this time around?
類似的案件，涉及其他名人在兩個星期前就已經已提交給檢察機關。
半個國有電視台將會推出一樣的封殺禁令嗎？電視台是否會比較有人性化的對待名字已經被警方向公眾公開的人物（當然是電視台和管理公司還沒有知悉的那些隱藏在黑暗中的名字）？
難道在這一時間,他們將決定繼續按照“無辜直到被證明有罪”原則？
