I don’t see compelling reasons for an appeal here. What is to be gained? He’s not going to deny the use so the only purpose would be to reduce the sentence. If the reason to fight the sentence is because of considerations intrinsic to his case that deserve airing or because of fundamental principles or rights at stake, I could see it. But if it’s because other people got off with less, that’s a non-starter. Every case is different, life lacks mathematical precision, & the outcome of an appeal is never certain. What is certain is that an appeal would engender fresh rounds of controversy & prolong finality, making it very difficult to plan ahead in the interim, especially for a public figure.

Do I think the sentence is stiff considering the totality of circumstances? Yes. As you know, I had felt optimistic for sometime even before the prosecutor’s recommended sentence. That was b/c I had felt in my gut that actual time in jail was extremely unlikely. (I could now reveal that I was betting on 2 to 3 months of suspended jail time, so I was off by at least 50% – so much for my pretty good streak up to that point!) I had hoped but never believed that, realistically, he had much of a chance getting monetary fine only. Why? Remember some time ago you asked me a series of questions, one of which was what would make a judge impose a tough sentence? I said something to the effect that a chief reason would be the growing concern by Korean drug enforcement authority that the relatively cheap E and K are rapidly gaining popularity among urban youth. Since that population segment is always described to be particularly susceptible to influence by celebrities, the court would feel the need to send a strong message through JH. Why him and not the others? B/c he’s the most well-known caught with E and K so far. All the publicity surrounding him and the sensational stories of urban youth using drugs and behaving wantonly in night clubs certainly did not help.

It’s only natural that there would be much chatter about his military service. Mandatory military service has always been a hot-button issue in Korea (and other countries with similar mandatory system), and there was a lot of interest after JH mentioned it during trial, was misunderstood and misquoted, and his lawyer was forced to explain the law to the press and the public in order to calm the fury. My rough understanding is that JH could (and would have to) serve in the military for two years, but probably not as the kind of class 2 or 3 soldier he said he wanted to be (longer physical training followed by active duty in some military base). But that is not his doing. I think most people understand, or are beginning to understand, that it is up to the military and that it would be the unintentionally ironic result of the interplay of military law and the judge’s sentence, where a heavier sentence could mean an easier service and vice versa. I think there are a number of famous actors/entertainers who finished off their military service in the same manner, near their home base. Would the critics now want to suggest that he receive a lesser sentence in order to serve in active duty?! Also, there are many legitimate and honorable reasons why some people could not be class 2 or 3 soldiers. Would the critics now want to denigrate all those who have served or are serving community-based military service?!
關於他服兵役這件事件上,自然將會有許多傳言。

I fully understand the frustration and the hurt and the anger. They take time to process and It’s healthy to vent. But ultimately, there’s no point in comparing sentences or viewing him purely as a victim. He was foolish to succumb to a friend’s seduction and was indiscreet to take drugs with strangers. It was an unfortunate misstep that, as long as it is kept a secret, would bind him to those people. He made the decision to owe up to it at great cost but at the same time freed himself from an insidious secret. These are not the thinking and actions of a bitter or self-pitying victim but a man who has the strength and presence of mind to make hard choices in order to rid a cancerous growth and lead the life he wants to lead. That’s a very positive outlook on life. That’s something to be treasured and honored.
我完全理解關於所有粉絲們的沮喪,痛苦和憤怒。

So, when one puts away the frustration and the hurt and the anger, the thing to focus on, as far as the sentence is concerned, is whether it nevertheless provides an opportunity for JH to return to a more normal life and, when he’s ready, to resume his acting pursuits down the road. I think so. As long as his record gets expunged at the end of a one-year suspension, whether it’s 1 month vs. 6 months is more a symbolic gesture by the judge on the seriousness of using E and K than anything else. (If he received only a monetary fine, I am sure there’d be howls of inappropriately lenient sentence. He can’t win one way or the other right now b/c he’s become a lighting rod, and anyone with access to a computer gets to opine.) Under the terms he could pay the fine, do the community service, and probably begin his 2-year military duty during suspension. Within a year, the sentence is over. He continues with his community-based military service till done. I thought it interesting that the judge made a special effort to mention the petitions. He didn’t need to but he did. From my perspective, he was essentially telling the young man that he’s got a lot of love and support out there and he should do something with it and not squander it. Indirectly, this mentioning confirms and broadcasts the strong support JH still enjoys among his fans, something the entertainment industry would take notice when deciding whether to take a chance on JH in the future. This is an important intangible if JH wants to pursue acting again, which he most likely will after a few years of quiet work away from the public eye. Ultimately, it is up to him to make the most of his life.

從我的角度來看,他主要是告訴這位年輕的男子,從請願書這方面,已經確切的證明,他還是擁有很多的愛和支持,並提醒他,在這片愛與支持的力量下,他應該做些什麼,而不是白白浪費了這些關懷。
間接證實了JH仍然從他的粉絲群中,享有強力的支持,而一些娛樂業將會注意到這一點,並在決定是否在未來決定給JH一個機會時考慮到這一部分。
如果JH希望再次追尋他的演藝生涯,這將是一項重要的無形資產,因為他很有可能將在幾年後,在進行低調的工作時,逐漸遠離了公眾的視線。說到底,那是由他自己決定,今後他的大部分生活將如何渡過。

同樣的,在了解阿呆的想法,心情這方面,她完全可以從很精準的角度,指出很多被大多數人所忽略的重點,來勸解一片憤憤不平之聲.
我一邊翻譯,一邊覺得感動.尤其在於,我們幾乎每個人都在埋怨法官審理上的偏差手法,
卻忽略了法官特定說出請願書這一要點,來隱喻了鼓勵阿呆的心情.(傻呆雖然呆,相信他可以體會到)
的確,法官可以說是決策人.什麼想說,什麼拒絕說,完全由他來決定.
他操控一切生死權.不管在刑罰,教誨被告或是譴責罪犯的事項上,無人可以指使他改變行事手法.
如果沒有律師提出這一要點,愚昧的我,真的完全漠視了.
更重要的是,律師也看出了阿呆破釜沈舟的堅決心態.
我們一般都把阿呆當成受害者(他的確也是受害者),總認為他可能是在沒有做好心理建設下,在警察局就這樣傻呼呼的自己坦承了一切.卻沒有想過(可能有人會思考到這一點,但是據我所知,一開始幾乎人人都認定阿呆是在沒有律師隨行的情況下,沒有專業人員給予保留性質的建議口供下,也在無法預測到其嚴重性,而自供了自己的錯誤)阿呆在去警察局時,也許早就已經決定把醞釀了許久,欲把毒瘤除之而痛快的心態下,堅定地選擇走向了這條將會付出昂貴代價的道路.
阿呆,你真讓我感覺到無比的驕傲!!!
律師的溫暖貼心,也在於顧慮到習慣性在未來歲月裡,將把自己隱藏在私人空間裡自我贖罪的阿呆,絕對需要定期的鼓勵與關懷.
